CUCKOO #SAMASAMA Sing To Win Contest

TERMS AND CONDITIONS

  1. The “#SAMASAMA Sing to Win” Contest will start on the 5th of September 2024 and end on the 30th of September 2024 at 23:59:59 PM GMT+8 (“Contest Period”). CUCKOO International (MAL) Berhad. [Co. No. 201401026804 (1102894-H)] (“Organiser”) shall reserve the absolute right to shorten or extend the Contest Period without prior notice. All submissions done outside the Contest Period will automatically be ineligible for the Prizes (as set forth under Clause 7) and will not be entertained by the Organiser.
  2. This Contest Terms and Conditions This Contest Terms and Conditions (“Terms) shall apply to this Contest. By participating in this Contest, you hereby agree to be bound by these Terms. shall apply to this Contest. By participating in this Contest, you hereby agree to be bound by these Terms.
  3. This Contest is open to all Malaysian citizens, aged 18 years old and above at the time the Contest Period commences (“Participants”). This Contest is not open to:
    1. Employees of the Organiser (including prospective employees and/or related companies) and their immediate family members (children, parents, siblings, and spouse); and/or
    2. Representatives of the Organiser, employees and/or advertising agencies and/or promotional service coordinators (including prospective employees and/or related companies,) and immediate family members (children, parents, siblings, and spouse).
  4. As part of this Contest, a social media post related to this Contest (“Contest Post”) will be published on CUCKOO’s official TikTok (@CUCKOOOfficial) or Instagram (@cuckoo_official) page (Contest Platform).
  5. To participate in the Contest:
    1. Ways to Enter the Contest:
      1. Follow CUCKOO’s official TikTok (@CUCKOOOfficial) or Instagram (@cuckoo_official) accounts.
      2. Search for the #SAMASAMA song sung by any of CUCKOO Brand Ambassadors.
      3. Duet or remix the song & post the video on your Tiktok or Instagram Feed.
      4. Participants are required to tag CUCKOO’s official Tiktok or Instagram account, along with the CUCKOO Brand Ambassador they duet with, and include the hashtags #SAMASAMASingToWin and #CUCKOO10thAnniversary.
      5. Winners will be selected based on creativity.
      6. Ensure the account privacy setting is “Public”.
      7. Participants may submit multiple entries from one account, but a participant/account can only win one prize.
  6. Winner Selection. Upon fulfilling and completing the requirements stipulated in Clause 5:
    1. From the eligible entries, CUCKOO will select a total of Thirty One (31) winners based on the most creative entries (“Winners”).
    2. The list of winners will be announced on the Contest Platforms or CUCKOO’s website (“Winner’s Announcement”) during the 2nd week of October.
    3. The listed winner on the Winner’s Announcement will need to provide their personal details including First Name, Last Name, NRIC, Email Address and Contact Number to the Contest Platforms’ inbox within three (3) working days from the date of the Winner’s Announcement to redeem their prize, failing which, will disqualify the winner from winning the Contest Prize as set forth in Clause 7.

    • Additional Prizes x30
      1 pair of CUCKOOTOPIA Music Fest Tickets.
  8. The Organiser reserves the right to substitute any prizes with that of similar value at any time without prior notice. All prizes are not transferable, refundable, or exchangeable in any other form for whatever reason. All prizes are given on an “as is” basis.
  9. All entries become the property of the Organiser. 
  10. Individuals are required to produce proof of identity during and prior to prize redemption for the purpose of identity verification. The only forms of proof of identity accepted by the Organiser are the Malaysian Identity card and Driver’s license. The Organiser has every right to disqualify the individuals should the individuals fail to provide any proof of identity as required by the Organiser.
  11. By participating in this Contest, you hereby agree and authorise the Organiser and its subsidiaries (“the Group”) to collect, use, process and/or disclose your personal data, as provided, for the facilitation of your participation in, and our administration of the Contest; and to conduct marketing, including contacting and/or sending you information, advertisements, invitations, and other promotional materials related to the Group’s product, services, initiatives, and events through post, phone, e-mail and other forms of electronic communication as the Group deems fit and proper in accordance with the Personal Data Protection Act 2010 and our Privacy Notice available at our website. Please visit our website for further details on the Privacy Notice, including how you may access and correct your personal data, withdraw/limit consent of the processing of your personal data or prevent the processing of your personal data for direct marketing purposes.
  12. The Organiser reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of the Terms without prior notice to you and you shall be bound to observe, perform, and comply with the Terms herein and any amendments thereof.
  13. The Organiser shall be entitled to take any form of action against any person or entity who abuses the contest, including but not limited to, any suspicious activities or any attempts to circumvent the Terms herein.
  14. The Organiser is not responsible or liable for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorised access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the internet and/or websites.
  15. The Organiser and any of its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers engaged by the Organiser for the purposes of the Contest) shall not be liable for any claim by any person, entity or third-party claims or losses of any nature, including but not limited to, loss of profits, punitive, indirect, direct, special, incidental, or consequential damages or for other damages and any related claims resulting from or in connection with the Contest.
  16. Participants of the Contest shall assume full liability and responsibility in case of any accident, injury, damage, or claim resulting from participation in this Contest.
  17. You acknowledge and agree that the Organiser reserves the absolute rights to disqualify your participation in the Contest if: i) you are found or suspected of tampering with the Contest mechanics or the operation of the Contest; ii) you are found or suspected of undertaking fraudulent activities or other activities that are harmful to the Contest; or iii) you are in breach of the Terms. Notwithstanding the foregoing, the Organiser reserves the right to reject the participation of any person or entity in the Contest at its sole and absolute discretion without assigning any reasons whatsoever.
  18. The Organiser shall not take any responsibility in the event you are prevented from participating in the Contest, as a result of certain technical restrictions or other limitations specifics or due to force majeure which, including but not limited to, regulatory and/or government directive, act of God, strikes, accidents, terrorism, epidemic, pandemic, civil or military disturbances, natural catastrophes, interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services.
  19. In the event any of the provision of the Terms is held invalid, illegal, and unenforceable under any applicable law or jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Terms or invalidate or render unenforceable such term or provision in any other jurisdiction. All remaining provisions of the Terms shall remain in full force and effect.
  20. No delay or indulgence by the Organiser in enforcing any of the Terms herein shall constitute a waiver by the Organiser of your breach of the Terms.
  21. The Organiser’s decision in any matter in relation to the Contest shall be deemed as final and conclusive. No further correspondence will be entertained by the Organiser.
  22. In the event of any discrepancy between the Terms herein as compared to the advertising, promotional, publicity and other materials relating to or in connection with the Contest, the Terms on the Contest Platform shall prevail.
  23. These Terms shall be governed by the laws of Malaysia and any dispute arising out of or in connection with the Contest shall be referred to the exclusive jurisdiction of courts in Malaysia.
