TERMS AND CONDITIONS
(“Terms and Conditions”)
By attending the CUCKOOTOPIA Music Fest, you agree to abide by the following terms and conditions:
- The CUCKOOTOPIA Music Fest (“Event”) is organised by CUCKOO International (MAL) Berhad (Company No. 201401026804 (1102894-H)) (“the Organiser”) with the following details: –
- Event Name : CUCKOOTOPIA Music Fest
- Date : 16th November 2024 (Saturday)
- Time : 5.00PM – 11.30PM
- Venue : Surf Beach, Sunway Lagoon
- Ticketing & Entry
- 2.1. Tickets for the Event are not available for sale and can only be obtained through official promotions, invitations, and/or selected campaigns.
- 2.2. Tickets purchased and/or obtained through unauthorised third-party sources are strictly prohibited and will not be honoured.
- 2.3. Tickets are non-transferable and non-exchangeable.
- 2.4. Entry tickets may be physical or electronic. For electronic tickets, a confirmation email containing a unique QR code will be sent to the attendees by the Organiser or the Organiser’s authorised third-party ticketing agency. This email serves as the electronic ticket for wristband collection.
- 2.5. Each electronic ticket contains a unique QR code that will be scanned and validated upon verification. Attendees are strongly advised not to post or share their electronic tickets online to avoid potential fraud or forgery.
- 2.6. Each ticket, whether physical or electronic, allows entry for ONE (1) person only.
- Ticket Redemption & Wristband Collection
- 3.1. Ticket holders must redeem their tickets for wristbands to gain entry to the Event.
- 3.2. Specific details regarding the location, dates and times for ticket redemption and wristband collection will be announced at a later date.
- 3.3. Each ticket holder must present a valid identity document (e.g., Identity Card, Driver’s Licence, or Passport) along with either a physical ticket or confirmation email containing unique QR code for verification, wristband redemption and/or entry.
- 3.4. The Organiser reserves the right to deny wristband issuance or entry to the Event if the documents provided are insufficient to verify the identity of the ticket holder, or the authenticity or validity of a ticket is questionable, including if the ticket has been used previously by others, damaged tickets or defaced in any way.
- 3.5. Upon verification, attendees will receive a wristband, which must be worn at all times during the Event. Those found without wristbands will be asked to leave the Event.
- 3.6. Once collected, attendees assume full responsibility for their ticket and wristband. Lost, stolen, or damaged tickets or wristbands will not be replaced or compensated.
- 3.7. Tampering with or removing wristbands will result in denied entry.
- 3.8. Re-entry into the Event is strictly prohibited.
- Age Restrictions
- 4.1. Children under the age of 12 are not permitted to attend the Event.
- 4.2. All attendees aged 12 and above must have a valid ticket for admission. No admission of child aged 12 to 18 years old unless accompanied by an adult aged 21 years old and above.
- 4.3. Adult ticket holders are responsible for ensuring compliance with any age-related admission restrictions and conditions.
- Event Rules and Conduct
- 5.1. Attendees are required to adhere to all Event rules, prohibitions and the instructions of authorised Event personnel.
- 5.2. During the Event, attendees must be able to provide valid identification if requested by a member of security or crew.
- 5.3. All attendees are expected to conduct themselves in a respectful and lawful manner. Unruly, disruptive or offensive behaviour and profanity is strictly prohibited and will not be tolerated.
- 5.4. Smoking (including e-cigarettes and/or vaping) is not permitted.
- 5.5. No pets allowed.
- 5.6. To ensure a comfortable and enjoyable experience for all, attendees are requested to wear appropriate attire throughout the Event,respecting the Event’s family-friendly environment.Clothing that is revealing, such as swimwear, bikinis, and similar attire, is not permitted.
- 5.7. The following items are prohibited and may result in confiscation: –
- (a) Illegal substances;
- (b) Drugs and alcohol;
- (c) Flammable items or liquids;
- (d) Weapons & dangerous items;
- (e) Musical instruments, noisemakers & whistles;
- (f) Water guns, spray bottle or misters;
- (g) Liquid, perfumes and vape;
- (h) Umbrellas and portable chairs;
- (i) Large bags;
- (j) Professional recording equipment, including cameras;
- (k) Outside food and beverages; and
- (l) Any other items deemed unsafe or unsuitable by Event personnel.
- 5.8. The Organiser cannot accept liability for any confiscated items.
- 5.9. Access to restricted areas —including production rooms, green rooms, press rooms, offices, backstage, and working areas—is strictly prohibited.
- 5.10. Attendees must not obstruct entrances, exits, or evacuation routes and should not linger in these areas longer than necessary. Defacing, marking, damaging, or destroying any part of the Event site is also prohibited.
- 5.11. The Organiser reserves the right to refuse entry or remove individuals for behaviour that endangers the safety or enjoyment of others, or for non-compliance with these terms, without any compensation.
- Security and Safety
- 6.1. Attendees will be subject to security screenings, including bag checks, both before and during the Event. The Organiser reserves the right to deny entry if security concerns arise. Attendees are required to cooperate fully with security personnel at all times.
- 6.2. Security personnel will be present at the Event to ensure safety of all attendees.
- Event Schedule and Lineup
- 7.1. The Event schedule, lineup, and performer list are subject to change at the sole discretion of the Organiser, without prior notice.
- Photography and Videography
- 8.1. By attending the event, attendees acknowledge and consent to being photographed, recorded (audio or video), or filmed by the Organiser, its representatives, sponsors, partners, and/or Sunway Lagoon Sdn Bhd. These recordings may be taken before, during, or after the event and may be used for promotional, marketing, and/or commercial purposes.
- 8.2. Attendees agree that any recorded material, including photographs, audio, or video footage, may be used in any format, including publications (both print and digital), audio-visual presentations, promotional materials, and advertisements. This usage will not entitle attendees to any fees, royalties, special credit, or compensation of any kind.
- 8.3. All photographs, recordings, and footage taken during the event, regardless of medium, shall remain the exclusive property of the Organiser.
- Lost or Stolen Items
- 9.1. The Organiser is not responsible for any loss, theft, or damage to personal property during the Event. Attendees are advised to keep their belongings secure at all times.
- Health and Safety Protocols
- 10.1. Attendees must comply with all health and safety protocols in place at the time of the Event, including any mandates by relevant authorities.
- 10.2. Medical services will be available on-site, but attendees assume full responsibility for any health-related incidents that may occur.
- 10.3. In the event of a medical emergency, consent is granted for medical care and transportation at the attendee’s own expense, as deemed necessary by the Event staff, security, police, or medical personnel.
- 10.4. Attendance at the Event constitutes an assumption of full risk of death, bodily injury, or property damage, regardless of severity, that may occur during the Event or while on the premises, whether or not caused by the negligence or gross negligence of the Organiser.
- Waiver
- 11.1. Attendees acknowledge that the ticket is a revocable licence to attend the Event and is subject to revocation or denial of admission without compensation for any reason, including but not limited to, a violation of the rules set forth in these Terms and Conditions, event policies, or any local, state, or federal laws, or actions that may endanger others at the Event.
- Liability and Release
- 12.1. Attendees acknowledge that they are fit to attend the Event and understand and assume all risks and/or danger, known or unknown, foreseeable and unforeseeable, resulting from, or incidental to and/or associated with the Event.
- 12.2. The Organiser are not liable for any injury, loss or damage sustained at the Event.
- 12.3. Attendees agree to indemnify and hold harmless the Organisers, its affiliate, and subsidiary companies, and each of their respective representatives, officers, directors, owners, members, trustees, agents, employees, successors and assigns, including the owners of the venues where the Event take place, the ticket agent(s), Event sponsors, the promoter(s), and the performing artists, including their respective management, agents, staff and designees (collectively, the “Organising Party”) from any loss, liability, damage or cost in any way arising out of or related to, your actions and omissions at, around, or while travelling to and from, the Event.
- 12.4. The attendees hereby waive, discharge, hold harmless and covenant not to sue the Organiser Parties from any and all liability arising out of or in connection with the Event, for any claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs or experiences of whatsoever kind, nature, or description arising out of, or related to the Event, your attendance at the Event, or your travel to and from the Event, whether or not caused by the negligence or gross negligence of the Organising Parties.
- Personal Data
- 13.1. By attending the Event, attendees agree and authorise the Organiser and its representatives to collect, use, process and/or disclose his/her personal data as well as the personal data of any accompanying children under the age of 18, in accordance with the applicable personal data law and regulations as well as the Organiser’s privacy notice which can be accessed at https://www.cuckoo.com.my/pdpa-consent.
- Force Majure
- 14.1. The Organiser is not liable for any delays, cancellations, or changes to the Event due to circumstances beyond its control, including but not limited to natural disasters, government actions, or other unforeseeable events.
- Governing Law
- 15.1. These Terms and Conditions shall be construed, governed and interpreted in accordance with the laws of Malaysia.
- Other Terms & Conditions
- 16.1. All other ticketing, venue & event entry terms & conditions apply.
